What is Mediation?

Mediation is a facilitated negotiation, where an impartial third party (the mediator) works to negotiate a settlement between the parties to a dispute. The parties drive the process, and the mediator helps them navigate.

How Mediation Works

Mediation begins with a phone call, where the mediator talks to each party separately about the dispute. Based on the details and complexity of the dispute, the mediator will schedule a mediation session that could be as short as 2 hours or as long as 8 hours. The parties will sign a mediation agreement that sets out the terms of the services to be provided.

The Mediation

Typical mediations begin and end with a joint session, where all parties are in the same room. The majority of the mediation will be spent with each party in separate rooms and the mediator moving between them while working to negotiate a settlement.

What is Arbitration?

Arbitration is a form of dispute resolution where an impartial third party (the arbitrator) hears and receives evidence from all sides of a dispute, and then makes a decision.

Arbitration is typically a faster and less expensive alternative to resolving a dispute through the legal system.

How Arbitration Works

Some kinds of disputes are subject to mandatory arbitration. In that case, the selected arbitrator will apply the policies and procedures the parties have already agreed to.

In other cases, parties may want to have a dispute decided by an arbitrator, but have no framework to do so. In this case, the arbitrator can work with the parties to establish the rules that will be followed in the arbitration. 

The Arbitration Hearing

The arbitration hearing is much like a streamlined court hearing. Each party presents their evidence to the arbitrator, and has the ability to question the other party's witnesses and offer rebuttal evidence.

After the hearing, the arbitrator will make a decision regarding the matter in dispute.

Early Neutral Evaluation

This is an informal process where the details of a dispute are provided to an impartial third party who can provide a neutral evaluation of the dispute and assess its strengths and weaknesses. This evaluation can often lead parties to find a pathway to resolution.

Neutral Fact-Finding

This is a process where an impartial neutral investigates an issue at dispute and then delivers a report to the parties. This can be especially useful when the dispute is technical in nature and the neutral is an expert in the subject matter.

Med/Arb and Arb/Med

A blended form of mediation and arbitration that combines aspects of each process. The driving force is still the need for the parties to negotiate a settlement, but the arbitration component provides an assurance that the matter will be decided by the neutral if the parties fail to reach an agreement.
